Terms and Conditions

These Terms and Conditions (the “Terms”) are a legally binding agreement between you and ParkSaathi Technologies (“ParkSaathi”, “we”, “us”, “our”). They apply to the ParkSaathi mobile app, the ParkSaathi website and every related service (together, the “Platform”). Please read them fully. By creating an account, ticking the box in the app, or using the Platform in any way, you confirm that you have read, understood and accept these Terms, our Privacy Policy and our Refund Policy. If you do not agree, do not use the Platform.

1. Acceptance and electronic record
These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it. They do not need a physical or digital signature. Your click, tick, sign-up or continued use of the Platform is your acceptance.
These Terms are published in line with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020, as they apply to us.
Our Privacy Policy and Refund Policy, and any rules or notices shown in the app, form part of these Terms.
The app shows these Terms and asks you to accept them each time you log in or create an account. We record the date and time of your acceptance and the version of the Terms you accepted (the “Last updated” date above), and you can’t use the app without accepting.
2. Definitions
- “Host” (also called Lister or Owner): a user who lists a parking space on the Platform.
- “Driver” (also called Finder): a user who searches for and books a parking space.
- “User” or “you”: any person who accesses or uses the Platform, as a Host, a Driver or both.
- “Listing”: a parking space offered by a Host, with its photos, description, location, price and other details.
- “Booking”: a Driver’s request for a time slot on a Listing and, once the Host accepts it, the arrangement between them for that slot.
- “Parking Fee”: the amount the Driver pays the Host for a Booking.
- “Platform Fee”: the commission a Host owes ParkSaathi for each completed Booking.
- “Verification”: our manual look at the documents and photos you upload, described in Identity and document checks.
3. What ParkSaathi is, and what it is not
ParkSaathi is a technology platform that lets Hosts publish information about their private parking spaces and lets Drivers find those spaces and send booking requests. We act only as an intermediary within the meaning of Section 2(1)(w) and Section 79 of the Information Technology Act, 2000.
ParkSaathi is not:
- a party to any Booking, or to any contract between a Host and a Driver;
- the owner, tenant, operator, manager or occupier of any parking space listed on the Platform;
- a bailee, custodian, warehouse or safe-keeper of any vehicle, key, accessory or item left in a vehicle. No bailment is created with ParkSaathi;
- a parking contractor, valet, security agency or guard service;
- a payment system operator, payment aggregator, escrow agent, bank or collection agent for any Parking Fee;
- an insurer, and we do not offer any insurance, deposit or guarantee;
- an agent, employer, partner or representative of any Host or Driver. Hosts are independent and are not our employees or agents.
We do not own, inspect, control or supervise any parking space, and we are not present during any Booking. Hosts alone decide whether to list, what to charge and whether to accept a request. Drivers alone decide whether to book and whether to park. We do not guarantee that any space will be available, suitable, safe or as described, or that any user will behave lawfully or honour a Booking.
4. Who can use ParkSaathi
To use the Platform you must:
- be at least 18 years old and competent to contract under the Indian Contract Act, 1872;
- be a resident of India with a valid Indian mobile number;
- not have been suspended or removed from the Platform before;
- use the Platform only for yourself, not on behalf of another person or a business, unless we agree in writing.
If you do not meet these conditions, you must not use the Platform. Any account created in breach of them may be deleted at once.
5. Your account
- You sign in with a one-time password (OTP) sent to your mobile number, or with Google. You may hold only one account.
- Everything you tell us (name, date of birth, address, phone number, documents, photos, listing details) must be true, current and your own. You must update it if it changes.
- You are responsible for everything done through your account, and for keeping your phone, SIM, OTPs and Google account secure. Never share an OTP with anyone, including someone who claims to be from ParkSaathi. We will never ask for it.
- Tell us at once at info@parksaathi.app if you think your account has been misused. We are not liable for any loss caused by use of your account before you tell us, or caused by your failure to keep it secure.
- You must not sell, transfer, rent or lend your account to anyone.
6. Identity and document checks
Before you can use the Platform, you must upload photos of your Aadhaar card (front and back) and a live selfie. Hosts must also upload a photo of a document showing their right to the parking space (for example a property tax receipt or rental agreement). You give these documents voluntarily and consent to us using them as set out in our Privacy Policy. We ask you to use a masked Aadhaar (first eight digits hidden). If you do not want to share Aadhaar, write to us and we will tell you which other government ID we can accept.
Our checks are manual and limited. A person at ParkSaathi looks at the images to see whether they appear genuine and consistent. We do not authenticate Aadhaar with UIDAI or any government database, we do not run police, credit or background checks, and we do not visit or inspect properties. As a result:
- approval of an account or Listing, or any “verified” label, only means that the documents we saw looked acceptable to us at that time. It is not a statement, warranty or guarantee about any user’s identity, character, conduct, solvency, ownership or right to list a space;
- documents may be forged, borrowed or out of date, and people may behave differently from how they appear. You must use your own judgement before dealing with any user;
- we are not liable for any loss arising from a user who gave false, forged or misleading documents or information, or from any error in our review.
We may approve or reject any account, document or Listing at our sole discretion, and we do not have to give reasons. You cannot use the Platform until your account is approved. A rejection is final: you cannot resubmit, and the account and its documents are deleted automatically 7 days after rejection, after which you may sign up again. Giving forged or someone else’s documents is a criminal offence, and we may report it to the police.
7. Rules for Hosts
By creating a Listing you confirm, promise and warrant, each time you list or accept a Booking, that:
- You have the full legal right to list the space: you own it, or you rent it and your landlord allows you to sub-let or share it. Where needed, you have the permission of your housing society, residents’ welfare association, apartment association, co-owners or any other person whose consent is required.
- The space is private property. It is not a public road, footpath, common area, fire exit, driveway you do not control, or any place where parking or commercial use is prohibited.
- Listing and renting out the space does not breach any law, lease, society bye-law, title document, loan or mortgage, municipal rule, building plan or zoning rule.
- Your Listing is true, complete and not misleading: the location, photos (which must be real, recent photos of that exact space), size, vehicle type it fits, access, amenities, rules and price. You alone are responsible for its accuracy. ParkSaathi does not check it and gives no warranty about it.
- The space is reasonably safe to use, and you will tell Drivers in advance about any hazard, restriction, height limit, gate timing or security check.
- You will make the space available for every Booking you accept, and give the Driver access for the full booked slot.
- You are responsible for any tax on your earnings (including income tax and, if it applies to you, GST), and for any property tax, society charges or fees related to the space.
Listing approval. Every Listing must have exactly 3 photos, a description, a price within the limits the app allows, your ownership type and a proof document. Your ownership type and proof cannot be changed after you submit. Each Host may have one active Listing. We approve Listings manually and may reject, pause, hide or remove any Listing at any time, with or without reasons. Changing the location, address or photos sends a Listing back for review.
Pricing. You set your own hourly price within the minimum and maximum the app allows. We may change those limits at any time.
Vehicles on your property. You must not damage, clamp, lock in, move, tow, use or hold back a Driver’s vehicle or belongings for any reason, including an unpaid Parking Fee or an overstay. Use lawful means only, and contact the police in an emergency.
Your own risk and insurance. You are responsible for your property, and for any injury, loss or damage suffered by any person on it. We strongly advise you to check that your home or property insurance covers this use.
8. Rules for Drivers
When you book and use a space, you confirm, promise and warrant that:
- You hold a valid driving licence, and your vehicle has a valid registration, insurance as required by the Motor Vehicles Act, 1988, and a valid PUC certificate.
- Your vehicle fits the space and matches the vehicle type in the Listing. You are responsible for checking the size, height, turning space and access before you park.
- You will park only in the booked space and only for the booked slot, follow the Host’s and society’s reasonable rules, and behave respectfully towards the Host, residents and staff.
- You will lock your vehicle and not leave valuables, documents, cash or keys in it. Anything left in or on your vehicle is entirely at your own risk.
- You will not carry or leave any illegal, dangerous, flammable (other than fuel in the vehicle’s tank), explosive, stolen or prohibited item, and will not use the space for living, sleeping, repairs, washing, selling or any other purpose.
- You are fully responsible for any damage, injury or loss you, your passengers or your vehicle cause to the Host, the property, other vehicles or any other person, including damage from leaking fluids.
- You will leave by the end of your slot. If you stay longer, the Host may charge for each extra hour or part-hour at the Listing’s hourly rate, which you must pay directly to the Host.
9. Bookings and cancellations
- A Driver sends a request for a time slot. The request is only an offer. It becomes a Booking only if the Host accepts it in the app. The Host may accept or decline any request for any reason (other than a reason that is unlawful).
- When a Host accepts a Booking, a contract is formed directly and only between the Host and the Driver. ParkSaathi is not a party to it. Other overlapping requests for the same slot are declined automatically.
- After a Booking is accepted, the app lets the Host and the Driver see each other’s phone number so they can coordinate. A request the Host does not answer before the slot ends is declined automatically.
- The Driver can cancel a pending or accepted Booking, and the Host can cancel an accepted Booking, in the app. ParkSaathi does not charge a cancellation fee. Any compensation for a late cancellation or a no-show is a matter between the Host and the Driver.
- A Booking is marked “completed” automatically when its slot ends. This only records the end of the slot; it is not a confirmation that the space was provided, that parking took place, or that anyone was paid.
- The app, notifications, maps, directions, timings and availability may sometimes be wrong, delayed or unavailable. You should confirm details directly with the other user.
10. Payments between Drivers and Hosts
ParkSaathi does not handle parking payments. The Driver pays the Parking Fee directly to the Host, normally by UPI when they arrive or as the two of them agree. There is no in-app payment, wallet or escrow.
- ParkSaathi does not collect, receive, hold, transfer, verify, guarantee or refund any Parking Fee, overstay charge or any other money between users, and is not liable for it.
- Any non-payment, short payment, late payment, wrong UPI ID, failed or reversed transaction, fraudulent payment, fake payment screenshot, chargeback or demand for extra money is solely between the Host and the Driver, and between them and their banks or UPI apps.
- Always check a payment has actually reached the right account before relying on it. Never share your UPI PIN, OTP or card details with anyone.
- The Host’s “Mark as paid” button is only the Host’s own record. ParkSaathi does not check it.
- The Driver must pay the Parking Fee shown in the app for the booked slot, plus any overstay charge. The Host must not ask for more than that.

11. Platform Fee (Hosts only)
- For each completed Booking, the Host owes ParkSaathi a Platform Fee of 12% of that Booking’s Parking Fee, plus any applicable taxes. The Driver never pays the Platform Fee.
- The fee is recorded as a due against the Host when the Booking is completed, whether or not the Host has collected the Parking Fee from the Driver. If a Booking did not actually take place, the Host may ask for the due to be waived under our Refund Policy.
- Hosts must pay their dues in the way and within the time we tell them, in the app or by message, phone or email. We may pause a Listing, block new Bookings, suspend an account and take legal steps to recover unpaid dues. Dues remain payable after an account is closed.
- We may change the Platform Fee rate by giving notice in the app or by email. A new rate applies only to Bookings requested after it takes effect.
12. Assumption of risk
Parking a vehicle on someone else’s property, and letting a stranger park on yours, carries real risks. By using the Platform, both Hosts and Drivers knowingly and voluntarily accept all of these risks as their own, including:
- theft of the vehicle, its parts, accessories, fuel, battery or anything inside it;
- scratches, dents, broken glass or mirrors, paint damage, tyre damage or any other damage, however caused;
- damage from fire, flooding, water-logging, rain, storms, falling trees, branches, walls, objects or debris, animals, pests, construction work or other vehicles;
- acts of other residents, guards, visitors, society staff or any third party, including vandalism, riots, strikes or civil unrest;
- towing, wheel-clamping, challans, fines or action by the police, traffic police, municipal bodies, a society or any other authority;
- personal injury, illness or death of any person on or near the property;
- the other user not turning up, cancelling late, denying access, overstaying, not paying or behaving badly;
- a space being inaccurate, unsafe, unlawful to use, or not available.
Drivers are responsible for insuring their own vehicles. Hosts are responsible for insuring their own property. ParkSaathi offers no insurance and no compensation.
13. No warranties
The Platform is provided “as is” and “as available”. To the fullest extent the law allows, ParkSaathi gives no warranty, representation or guarantee of any kind, express or implied, including about:
- any user, Listing, parking space, vehicle, document, photo, rating, review or other content provided by users;
- the identity, background, ownership rights, safety, reliability or conduct of any user;
- the accuracy of maps, locations, distances, directions, availability, prices or notifications;
- the Platform being uninterrupted, timely, secure, free of errors, bugs or viruses, or fit for any particular purpose.
Ratings and reviews are the personal opinions of users. We do not verify them and are not responsible for them.
14. Limitation of liability
To the fullest extent permitted by applicable law:
- ParkSaathi, its founders, directors, employees, contractors and service providers are not liable for any loss, damage, cost, claim or injury arising from or connected with: any Booking; any parking space or property; any vehicle or its contents; any act, omission, statement, document, payment or non-payment of any user or third party; any dispute between users; or any of the risks listed in Assumption of risk.
- We are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for any loss of profit, income, business, opportunity, data, goodwill or time, even if we were told it was possible.
- If, despite the above, ParkSaathi is found liable to you for anything, our total liability for all claims together is limited to the higher of (a) the total Platform Fees you actually paid us in the 6 months before the event giving rise to the claim, and (b) ₹1,000.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under Indian law, including liability for our own fraud, or any right you have as a consumer that the law does not allow to be waived. If any part of this section is held unenforceable, the rest of it still applies to the fullest extent allowed.
15. Indemnity
You agree to indemnify, defend and hold harmless ParkSaathi, its founders, directors, employees, contractors, affiliates and service providers from and against any claim, demand, action, proceeding, notice, penalty, fine, loss, damage, liability, cost or expense (including reasonable legal fees) made by any person, including another user, a housing society, a landlord, an insurer or any government, police, tax, municipal or other authority, arising out of or relating to: (a) your use of the Platform; (b) any Listing, Booking or parking space you are involved in; (c) your vehicle, property or conduct, or that of anyone you are responsible for; (d) any payment or non-payment between you and another user; (e) your breach of these Terms or of any law, bye-law, lease or third-party right; or (f) any information or document you provide that is false, forged, misleading or not yours to share. This indemnity survives the end of your account.
16. Disputes between users and release
Any dispute about a Booking, a parking space, a vehicle, damage, loss, payment, behaviour or anything else between a Host and a Driver must be resolved directly between them, and if needed through the police, their insurers or the courts.
We may, but do not have to, look into a complaint, share information with the parties or the authorities as the law allows, or take action on an account. Anything we do to help is voluntary, is not an admission of any responsibility, and does not make us a party to the dispute.
To the fullest extent the law allows, you release ParkSaathi and its founders, directors, employees and service providers from all claims, demands and damages of every kind, known and unknown, arising out of or connected with any dispute between you and another user.
17. What you must not do
In line with Rule 3(1)(b) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you must not host, display, upload, publish, send, store or share any information that:
- belongs to another person and to which you have no right;
- is obscene, pornographic, paedophilic, invasive of another’s privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, relates to or encourages money laundering or gambling, or promotes enmity between groups on the basis of religion or caste with intent to incite violence;
- is harmful to children;
- infringes any patent, trademark, copyright or other proprietary right;
- deceives or misleads about where a message came from, or knowingly shares information that is patently false, untrue or misleading;
- impersonates another person;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or incites any offence, or prevents the investigation of any offence, or insults another nation;
- contains software viruses or any code designed to interrupt, destroy or limit the functioning of any computer resource;
- is patently false and untrue, and is written or published with the intent to mislead or harass a person, entity or agency for financial gain or to cause injury to any person; or
- violates any law in force.
You also must not:
- use the Platform for any unlawful purpose, or to list or book a space you have no right to use;
- arrange Bookings found on the Platform outside the Platform to avoid the Platform Fee;
- harass, threaten, stalk, abuse, discriminate against or cheat any user, or misuse any phone number, address or other personal information you get through the Platform;
- post fake Listings, fake ratings or reviews, or rate yourself through another account;
- use a fake GPS location, emulator, rooted-device tool, bot, scraper or automated means, or try to get around any security or technical limit;
- reverse engineer, copy, modify, resell or interfere with the Platform or its servers (see Our intellectual property).
If we become aware of any such content or conduct, we may remove it, disable access and suspend or terminate the account, and we may keep related information and share it with the authorities as the law requires.
Reporting. You can report a Listing (“Report this listing” on its page), a Host (the flag on your booking) or a Driver (“Report driver” on a booking request) from the app, or write to us using “Contact Support”. Each report opens an email to us with the details we need. We review reports and act on them at our discretion; a report does not make us responsible for the matter reported.
18. Your content and ratings
You own the photos, descriptions, ratings, comments and other content you submit. You give ParkSaathi a non-exclusive, royalty-free, worldwide, transferable and sub-licensable licence to host, store, copy, display, adapt (for example resize or compress) and show that content to operate, improve and promote the Platform. For Listings, this lasts as long as the Listing is on the Platform and for as long as we need to keep booking records.
You are solely responsible for your content. We may review, refuse, edit or remove any content at any time, but we do not have to monitor it.
19. Calls, messages and notifications
You agree that we may send you OTPs, push notifications, SMS, emails and calls about your account, Bookings, dues and important changes, even if your number is on the National Do Not Call register, since these are service messages. You can turn off push notifications in your phone settings, but you may then miss booking updates. You agree that other users may call you on your registered number about an accepted Booking.
20. Suspension and termination
We may, at our sole discretion, with or without notice and with or without giving reasons, refuse, suspend, restrict or terminate any account, remove any Listing or cancel any pending Booking, including if we believe you have broken these Terms or the law, given false information, put anyone at risk, received complaints, or not paid your dues, or if a court or authority asks us to.
You may stop using the Platform and delete your account at any time from Profile → Delete account in the app (or by email), as described in our Privacy Policy. You can reopen a deleted account within 7 days by creating an account again with the same mobile number or Google account; after that, it and its data are permanently deleted. You can’t delete an account while it has upcoming Bookings. Any unpaid dues, responsibilities under upcoming Bookings, and the sections on payments, Platform Fee, assumption of risk, no warranties, limitation of liability, indemnity, release, governing law and disputes survive the end of your account.
21. Third-party services
The Platform uses services from other companies, such as Google Maps, Google Sign-In, Firebase, our hosting provider, SMS providers and your UPI app or bank. Your use of them is also subject to their own terms. We are not responsible for their availability, accuracy, security or actions.
22. Our intellectual property
The ParkSaathi name, logo and brand, the app, the website, their source code, screens, design, text, graphics, photos (other than user content) and the listings database belong to ParkSaathi Technologies or our licensors. They are protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and other laws of India.
We give you a personal, limited, revocable, non-exclusive, non-transferable licence to use the app on your own device for its intended purpose. You get no other rights. Without our written permission, no one may:
- copy, clone, imitate or recreate the app, the website or their design, features or content, or build a competing product from them;
- use the ParkSaathi name or logo, or any confusingly similar name, logo or domain, for any product, service, app listing or social media account;
- scrape, extract, copy or reuse Listings, photos or any other data from the Platform, by bot or by hand;
- decompile, reverse engineer or modify the app, or get around any of its security features.
We take copying seriously. If anyone breaks this section, we may suspend or terminate their account and take civil and criminal action, including claims for an injunction, damages and costs under the Copyright Act, 1957, the Trade Marks Act, 1999 and the Information Technology Act, 2000. We may also ask app stores, hosting providers and domain registrars to take the infringing product down. Nothing in Governing law and resolving disputes with us stops us from going directly to court for urgent relief to protect our intellectual property.
Report a copy. If you see an app, website or account copying or pretending to be ParkSaathi, write to info@parksaathi.app with a link to it.
24. Events outside our control
We are not liable for any delay or failure caused by events beyond our reasonable control, including natural disasters, floods, epidemics, riots, strikes, government orders, internet, power, telecom, SMS, map or cloud service failures, or cyber-attacks.
25. Governing law and resolving disputes with us
These Terms are governed by the laws of India. If you have a complaint against ParkSaathi, you agree to first write to our Grievance Officer (see Grievance Officer and contact) and give us 30 days to try to resolve it.
Any dispute with ParkSaathi that is not resolved this way will be referred to arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement (or, failing agreement, as provided in that Act). The seat and venue will be Bengaluru, Karnataka, the language will be English, and hearings may be held online. Claims must be brought only in your individual capacity, not as a representative or class action, to the extent the law allows.
Subject to the above, the courts at Bengaluru, Karnataka have exclusive jurisdiction. Nothing in this section takes away any right you have under the Consumer Protection Act, 2019 that the law does not allow to be waived.
26. Changes to these Terms
We may update these Terms from time to time. We will change the “Last updated” date and, for important changes, tell you in the app or by email. When the Terms change, the app asks you to accept the new version before you can continue. If you keep using the Platform after the changes take effect, you accept them. If you do not agree, stop using the Platform and ask us to delete your account. We will remind users of these Terms and our Privacy Policy at least once a year, as the IT Rules require.
27. General
- These Terms, with the Privacy Policy and Refund Policy, are the entire agreement between you and ParkSaathi about the Platform.
- If any part of these Terms is found invalid or unenforceable, it will be limited to the minimum extent needed, and the rest remains in full force.
- If we do not enforce a right, that is not a waiver of it.
- You may not transfer your rights or duties under these Terms. We may transfer ours, for example as part of a merger, sale or reorganisation.
- Headings are for convenience only. “Including” means “including without limitation”.
- If these Terms are translated, the English version prevails in case of any difference.

We will acknowledge a complaint within 24 hours and try to resolve it within 15 days of receiving it. Please include your registered phone number, the Booking or Listing involved, and any screenshots. The same address handles general help requests.
